Terms of Use

This page states the Terms of Use (“Terms”) under which you (“You”) may use the jobopportunity.sx sites and services. These Terms include the Privacy Policy that is referenced on this page.


These Terms constitute a binding agreement between You and JobOpportunity.sx and the Department of Labor Affairs & Social Services. If You do not accept to the Terms stated here, do not use the JobOpportunity sites and services.


Sites & Services

The JobOpportunity sites are defined as any websites under JobOpportunity’s control, whether partial or otherwise (including, without limitation, Opportunity.sx, QuickJobs.sx, and the website from which these terms of use were accessed from) and include the JobOpportunity services. These sites also include the online communities and communication tools designed to facilitate professional networking among users of the JobOpportunity website. This website, jobopportunity.sx, allows Users to create individual profiles, which may include personal information, and make these profiles and / or aspects thereof public.

The JobOpportunity services are defined as the applications and services offered by JobOpportunity.  This includes an online service to post and search employment opportunities including any application accessed through our social media platform and / or any mobile or other interface that allows You to access such application.

JobOpportunity may revise these Terms at any time by posting an updated version to this web page. You should visit the page periodically to review the most current Terms as they are a binding agreement with You.

Users who violate these Terms may have their access and use of the JobOpportunity sites suspended or terminated, at JobOpportunity’s discretion.


Required Age

You must be 18 years of age or older to use any JobOpportunity sites and services. If under the age of 18 or the age of majority as defined in Your jurisdiction, You must use any JobOpportunity site with permission from a parent or legal guardian.


The use of JobOpportunity Content and / or Profiles to determine a consumer’s eligibility for insurance for personal, family, or household purposes is strictly prohibited.


Use of JobOpportunity Content

JobOpportunity authorizes You, subject to these Terms, to access and use the JobOpportunity sites and content (as defined below)


Use of JobOpportunity Services

The job posting, resume database, and other features of the Jobopportunity sites may be used only by individuals seeking employment and / or career information and by employers seeking employees. In addition, Jobopportunity Profiles and Networking may be used by individuals for permitted professional and personal networking purposes. Your use of jobopportunity is also subject to any other contracts Yo may have with Jobopportunity. In the case of any conflict between these Terms & Conditions and any contract that you have with Jobopportunity, the terms within your contract will prevail.

The term “post” as used herein shall mean information that You submit, publish or display on a Jobopportunity site. You are responsible for maintaining the confidentiality of Your account, profile, and passwords. It is strongly advised that You do not share Your password or other account access information with any other party, temporarily or permanently. You shall be responsible for all uses of Your Jobopportunity site registrations and passwords, whether or not authorized by You.


All JobOpportunity Users agree to not:


  • Transmit , post, distribute, store and / or destroy material, including, without limitation, Jobopportunity content, in violation of any applicable law or regulation. This includes any laws and / or regulations governing the collection, processing, or transfer of personal information, or in breach of Jobopportunity’s privacy policy.
  • Use any data mining, robots and / or similar data gathering or extraction methods.
  • Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting.
  • Reverse engineering or recompiling any parts of any Jobopportunity site.
  • Post any content or material that promotes or endorses false or misleading information or illegal activities, or endorses or provides instructional information about illegal activities or other activities prohibited by these Terms & Conditions, such as making or buying illegal weapons, violating someone’s privacy, providing and / or creating computer viruses and / or pirating media.
  • Defer any contact from an employer to any agent, agency, and / or other third party.
  • Post and / or submit to any Jobopportunity site any incomplete, false and / or inaccurate biographical information. This includes information which is not Your own.
  • Post content that contains restricted or password only access pages, or hidden pages or images.
  • Solicit passwords and / or personally identifiable information from other Users.
  • Delete and / or alter any material posted by any other person or entity.
  • Harass, incite harassment or advocate harassment of any group, company, or individual.
  • Send unsolicited mail or email, make unsolicited phone calls or send unsolicited information promoting and / or advertising products or services to any User, or contact users that have specifically requested not to be contacted by You.
  • Attempt to interfere with service to any User, host and / network, including, without limitation, via means of submitting a virus to any Jobopportunity site, overloading, spamming, mailbombing, and / or crashing.
  • Promote and / or endorse an illegal or unauthorized copy of another person’s copyrighted work, such by as providing and / or making available pirated computer programs or links to them. Providing or making available information to circumvent manufacture installed copy protected devices, or providing and / or making available pirated music or other media and links to pirated music. This also includes other media files.
  • Post any resume and / or profile or apply for any job on behalf of another party.
  • Take any action that imposes an unreasonable or disproportionately large load on any Jobopportunity’s infrastructure.

Additional Terms Applicable to Employers

Employers are solely responsible for their respective postings on JobOpportunity sites. JobOpportunity is not to be considered an employer with respect to Your use of any JobOpportunity site and shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on any JobOpportuntity site.


You, the Employer, understand and acknowledge that if You cancel Your employer account or, if Your employer account is terminated, all of the information associated with this account will be marked as deleted and may be deleted from JobOpportunity databases. This includes any and all saved resumes, job postings, network contacts, email mailing lists, and account specific content. Information may continue to be available for some period of time due to delays in propagating such deletion through JobOpportunity’s web servers.


Job Postings


Job postings may not contain:


  1. Any hyperlinks, other than those specifically authorized by JobOpportunity;
  2. Misleading , unreadable, or “hidden” keywords, repeated keywords or keywords that are irrelevant to the job opportunity / vacancy being presented;
  3. The names, logos and / or trademarks of unaffiliated companies other than those of your customer unless expressly agreed by JobOpportunity;
  4. The names of colleges, districts, cities, states, and / or countries that are unrelated to the posting;
  5. Inaccurate, false, or misleading information;
  6. Material or links to material that exploits people in a sexual, violent manner, and / or solicits personal information from anyone under 18.

JobOpportunity job postings, networking, and profiles may not be used to:
  1. Post jobs in a manner that does not comply with the applicable local and international laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property.
  2. Sell, promote, and / or advertise products or services.
  3. Post any franchise, pyramid scheme, “club memberships”, distributorship, multi-level marketing (MLM) opportunity, or sales representative agency arrangement.
  4. Post any business opportunity that requires an up-front payment and / or requires recruitment of other members, sub-distributors or sub-agents.
  5. Advertise sexual services or seek employees for jobs of a sexual nature.
  6. Request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy.
  7. Endorse a particular political party, political agenda, position and / or issue.
  8. Promote a particular religion.

Removals

Jobopportunity reserves the right to remove any job posting or content from any Jobopportunity site, which in the reasonable exercise of Jobopportunity’s discretion, does not comply with the aforementioned Terms & Conditions. This also includes any content posted that Jobopportunity deems as not in the best interest of the website.

Resume Database

Use of the Jobopportunity Resume Database by Employers


The use of the Jobopportunity resume database is only allowed as provided by these Terms & Conditions and any contact that You may have with Jobopportunity. You must use our Resume Database in accordance with all applicable privacy and data protection laws, You agree not to disclose any of the data from the Jobopportunity Resume Database to any third party unless You are authorized to do so for employment purposes. You agree to take all and any appropriate measures to protect the data You have obtained from Jobopportunity Resume Database from loss, misuse, unauthorized access, disclosure, alteration or destruction.


The Jobopportunity Resume Database shall not be used:


  1. For any purposes other than as an employer seeking employees, including but not limited to advertising promotions, products, or services to any resume holders;
  2. To make unsolicited contact to any resume holder or Jobopportunity job seeker unless they have agreed to be contacted where consent is required or, if expressed consent is not required, who has not informed you that they do not want to be contacted).
  3. To source candidates or to contact job seekers or resume holders in regards to career fairs and business opportunities.

Additional Terms Applicable to Job Seekers

When You register with any Joboportunity site, You will be asked to create an account and provide us with certain information including without limitation, a valid email address.


Any profile submitted by You must be accurate and describe You, the individual person. The profile requires standard fields to be completed and You agree to complete these fields truthfully. You agree that You are solely responsible for the form, content and accuracy of any resume or material contained therein placed by You on Jobopportunity sites.


Jobopportunity reserves the right to delete Your account and all of Your information after significant duration of inactivity and / or failure to comply with these Terms & Conditions. This includes user content that:


  • Is implicitly or explicitly offensive, such as User Content that engages in, endorses or promotes racism, bigotry, discrimination, hatred or physical harm of any kind against any group or individual;
  • Harasses, incites harassment advocates harassment of any group or individual;
  • Involves the transmission of “junk mail”, “chain letters”, “spam”, and / or unsolicited mass mailing, or “phishing”;
  • Promotes or endorses false or misleading information or illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
  • Promotes or endorses an illegal or unauthorized copy of another person’s copyrighted work, such as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files;
  • Contains restricted or password only access pages, or hidden pages or images;
  • Displays or links to pornographic, indecent or sexually explicit material of any kind;
  • Provides or links to material that exploits people under the age of 18 in a sexual, violent or other manner, or solicits personal information from anyone under 18;
  • Provides instructional information about illegal activities or other prohibited by these Terms, including without limitation, making or buying illegal weapons, violating someone’s privacy, providing or creating computer viruses or pirating any media;
  • Solicits passwords and / or personal identifying information from other Users.

Any profile submitted by you must describe You, an individual person. Examples of inappropriate and prohibited profiles include, but are not limited to, profiles that purport to represent an animal, place, inanimate object, fictional character, or real individual that is not You.


Termination of Users

The following policy regards the terms for which a User’s account can be terminated for infringing on the copyright or other Intellectual Property Rights of others.


Jobopportunity respects the Intellectual Property of others, and we ask our Users, both Employers and Job Seekers, to do the same. The unauthorized posting, reproduction, copying, distribution, modification, public display and / or public performance of copyrighted works constitutes infringement of the copyright owners’ rights. As a condition to Your use of the Jobopportunity sites, You agree not to use any Jobopportunity site to infringe the intellectual property rights of others in any way. We reserve the right to terminate the accounts of any Users and block access to the Jobopportunity sites of any Users who are repeat infringers of the copyrights, or other intellectual property rights of others.


Disclaimer of Warranty

To the fullest extent possible by law, Jobopportunity does not warrant that any Jobopportunity site or any Jobopportunity services will operate error-free or that any Jobopportunity and its servers are free of computer viruses or other harmful mechanisms. If your use of any Jobopportunity site or the Jobopportunity content results in the need for servicing and / or replacing of equipment or data or any other costs, Jobopportunity is not responsible for those costs. The Jobopportunity sites and content are provided on an “As Is” basis without any warranties of any kind. Jobopportunity, to the fullest extent permitted by law, disclaims all warranties, whether expressed or implied, including the warranty of merchantability, fitness for particular purpose and non-infringement. We, Jobopportunity, makes no warranties about the accuracy, reliability, completeness, or timeliness of the Jobopportunity content, services, software, text, graphics, and links.


Disclaimer of Consequential Damages

To the fullest extent possible by law, in no event shall Jobopportunity, its collaborators, or any third parties mentioned on any Jobopportunity site be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data, lost employment opportunity or business interruption) resulting from the use of inability to use any Joboppportunity site and its content, whether based on warranty, contract, tort, or any other legal theory, and whether or not monster is advised of the possibility of such damages.


Links to Other Sites

The Jobopportunity sites contain links to third party websites. These links are provided solely as a convenience to You and not as an endorsement by Joboportunity of the contents on such third-party websites. Employers are allowed to post links to their respective websites as long as it complies with the User Content terms and conditions stated herein. Jobopportunity is not responsible for the content of linked third-party website and does not make any representations regarding the content or accuracy of materials on such third party website. If You decide to access linked third-party websites, You do so at Your own risk.


Resale of Unauthorized Commercial Use

You agree not to resell or assign Your rights or obligations under these Terms. You also agree not to make any unauthorized commercial use of any Jobopportunity site.

Department of Labor Affairs & Social Services Employment & Labor Related Legislation

The National Employment Services Center (NESC) and the execution of such is governed by two important pieces of legislation;

  1. The National Ordinance on the establishment of Labor Affairs AB 2013, GT no. 343

  2. The National Organizational Decree on Public Health, Social Development and Labor AB 2010 no. 5”


NESC is tasked with assisting employers with finding employees and to assist employees with finding employment opportunities. Similarly, NESC should execute labour market policy to ensure an honest division of supply of labour for employers and employees. Based on the aforementioned, NESC is responsible for the execution of three (3) important services in order to ensure the realization of the aforementioned guidelines.


  1. to place job seekers in suitable positions, the acquisition of vacancies;

  2. to ensure that persons maintain employment and;

  3. to promote Social Corporate Responsibility amongst employers.


Businesses that opt to utilize Jobopportunity to advertise vacancies in connection with an employment permit will not be exempt from the provisions as noted in the National Ordinance for Foreign Labor Execution Resolution Foreign Employment Permit Policy AB 2013 GT. no 357 as article ; as this arti does not have a direct impact on the mandate, there is nevertheless an indirect regulatory impact; as it requires employers in cooperation with the department to source persons locally for available vacancies.
